Waiver

This contract for Travel and/or leisure services (the “services”) between the customer and We Welcome Wheelchairs transportation (hereinafter referred to as the “service provider”) is subject to the following terms and conditions.

By participating, the Customer assumes the risk of personal injury, loss or damage to him/herself and his/her personal possessions. The Customer hereby releases and discharges the service provider from, all liability for any direct, indirect, punitive, incidental, special or consequential damages, arising from or related to the provision of services, including economic loss and physical or mental injury, or any act, omission or negligence. In so far as the Service Provider is unable by law or by statute to exclude its liability, the customer agrees that the liability of the service Provider is limited to the value of the services purchased.

The Customer acknowledges having read and understood the tour Operator’s terms and Conditions on Optional Tours, Excursions and Activities, and as such, agrees to forever discharge and indemnify the Tour Operator with whom the Customer traveled from his country of embarkation, its corporate parents, subsidiaries, affiliates directors, employees, officers and agents from any and all claims of any nature related to or arising out of such services. The Service Provider does not have the authority to modify or waive any provision of these Tour Operator Terms & Conditions. (if applicable).

The Customer hereby grants to the tour Operator the right to take his/her photographs/videos in connection with Customer’s participation in the activities, also authorizes the Tour Operator to copyright, use, and publish the same in print and/or electronically. The Customer agrees that The Tour Operator may use such photographs for any lawful purpose, including but not limited to publicity, illustration, advertising and web content.

If any portion of this agreement is held invalid or unenforceable, the remaining portions will remain in full force and effect and, where possible, the portion found unenforceable will be construed in a manner consistent with the remaining portions.

This contract is governed by and construed according to the laws of Aruba, and the Customer is bound to the exclusive jurisdiction of the said courts.

The Customer acknowledges having read and understood all the above terms and conditions and agrees to be bound by same. The Customer acknowledges that by signing this document he or she will waive certain legal rights, including the right to sue.

We value your trust in providing us your Personal Information, thus we are striving to use commercially acceptable means of protecting it. But remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and we cannot guarantee its absolute security.

No refund for unused services. We believe you won’t cancel if you don’t have too. Since the booking is free, you will create more opportunities for other travelers with special needs if you cancel on time.
